Should I take the Bankruptcy Route?

There are a few factors to consider. If you do decide to take the bankruptcy option, the bankruptcy will appear on your credit reports for 7 to 10 years. Also, it will depend the article that you are eligible for, but in most cases you will have to pay a percentage of your debt up front to start the process, you will be required to provide forms such as: 3 years of Tax forms, a year of bank statements, 2 months of pay stubs and up to $2,500 in lawyers fees. Aside from all the initial requirements, you will also be subject to higher interest fees in future financial commitments such as credit cards, personal loans and mortgage loans.

How does the debt reduction program works?

What happens to my credit during the program?

It will depend on the status of your credit at the time of enrollment. If you have a delay of 30, 60 days or more on your accounts then by participating in our program there is a high probability that your credit score will improve. Regardless of your credit score at the time of enrollment, in the mid term your credit score will improve more if you eliminate all of your debt within 2 years that if you continue to drag your debt for 10 , 15 years by making minimum payments. Our main objective is to assist or clients to eliminate their debt in the fastest way possible and help them take control of their finances. We do understand that Credit Reports are important, but not as important as being able to pay your full debt at a fraction of the original debt. Maintaining your debt in order and reported to the credit agencies it’s a positive element.

Do I have to pay all the arrangements immediately?

No, your budget dictates the quickness of what and how much debt you can pay at once.the majority of our clients have a very limited budget and can only pay one debt at a time. What are the tax consequences?

If you are deeply in debt, it is unlikely that you have a positive net value, which means it is unlikely that you will have to pay taxes on your reduced debt. The law requires that financial institutions disclose canceled debts of $600 or more (the forgiven amount during the transactions of the establishment) to the IRS. The IRS allows you to net any “income” of debt cancelled with the amount that you were insolvent when the debt was cancelled. You are defined as insolvent when you owe more than what you have, or you have net negative value. There are exceptions, please contact a tax professional for more information.
